Nacchio's conviction for insider trading and six-year prison sentence were overturned in March 2008 by a three-judge federal appeals panel in Denver. The panel ruled that the trial judge had erred by not allowing expert testimony from a defense witness. After a rehearing of the case, the 10th U.S Circuit Court of Appeals reinstated his conviction, and he recently began serving his sentence.
