Sun asks court to bar Microsoft from using Java-compatible logo on IE 4.0

NEW YORK (CNNfn) - Sun Microsystems Inc. Tuesday asked a federal district court to bar Microsoft Corp. from using its Java-compatible logo on Internet Explorer 4.0 web browser.
Sun said it did not want Microsoft using the logo because the Java technology used in IE 4.0 and related products does not pass compatibility tests.
"We take very seriously our stewardship of this remarkable technology, which includes keeping the promise of cross-platform compatibility that our logo stands for," said Michael H. Morris, Sun's vice president and general counsel.
Sun is accusing Microsoft of deliberately violating licensing agreements, attempting to break the cross-platform compatibility of Java and of attempting to deliver a version of Java that only works with Microsoft products.
Sun alleges that independent tests show Internet Explorer 4.0 failed to pass its Java compatibility tests and do not qualify to use the Java logo.
Sun's filing was part of its response to counterclaims by Microsoft. Late last month, Microsoft filed a countersuit against Sun, charging it with breach of contract and good faith over confidential Java contracts.
In early October, Sun filed a brief of contract lawsuit against Microsoft, seeking unspecified damages and an injunction. It is also seeking $35 million in damages.
