Klein confident government will prevail despite appeals court ruling

NEW YORK (CNNfn) - Assistant Attorney General Joel Klein remains confident that the government will prevail in its antitrust fight with software giant Microsoft Corp. despite an appellate court setback
Microsoft scored a victory Tuesday when a federal appeals court struck down a preliminary injunction preventing Microsoft from forcing PC makers to include the Internet Explorer Web browser in the Windows 95 operating system.
"[The ruling] didn't involve enforcement of antitrust laws. We have a case pending in federal court.
that will show a series of monopolistic practices and an intent to protect Microsoft's position in the operating system market," Klein said.
Appearing Wednesday on "Moneyline News Hour with Lou Dobbs,"Klein said that the Justice Department is still considering an appeal. "We're considering all our options," Klein said. "At this point there are no settlement negotiations."
Klein said the growing number of mergers and the long-running Microsoft case are keeping antitrust regulators busy. However, Klein is confident each case will receive the proper scrutiny.
"The attorneys, economists and support staff are enormously committed to the mission and have been working extended hours. Consumers know competition brings better choices, lower prices and better opportunities. Our role is to make sure that competition is robust. That's what has done good things for our economy," he said.
Klein said mergers that are good for the economy and consumers will clear regulatory hurdles. He said regulators are equally committed to ensuring tie-ups that will hurt competition are thwarted.
