Is This Land Your Land?

(FORTUNE Small Business) – The institute for Justice is headed to the Supreme Court this winter to argue a case that may matter to your business. The nonprofit Washington, D.C., law firm (see "Libertarians and Justice for All?" on fsb.com) will fight what it sees as the growing abuse of eminent domain law, which says the government can take private property for public use, such as roads, parks, or schools. Increasingly, local governments are turning land over to private developers for the "public use" of increasing the tax base and creating jobs. If such seizures are allowed, argues the institute's senior attorney Scott Bullock, any small business could be replaced by a larger one. A verdict is due in June. —JULIE SLOANE
