Novell files another Microsoft suit
Alleges anti-trust practices hurt its WordPerfect program; comes days after separate settlement.

NEW YORK (CNN/Money) - Just days after settling one anti-trust lawsuit with Microsoft, Novell filed another one.

According to a Novell (down $0.05 to $7.15, Research) press release, the company said it had decided to file the second suit before the settlement of the first suit was announced.

In the second suit, Novell is alleging that Microsoft (down $0.01 to $29.97, Research) withheld critical information about its Windows operating system that prevented Novell from making improvements to its WordPerfect word processing software. Novell has since sold WordPerfect. The amount of damages sought was not specified.

"Microsoft integrated certain technologies into Windows designed to exclude WordPerfect and other Novell applications from relevant markets," Novell said in a press release. "In addition, Microsoft used its monopoly power to prevent hardware partners from offering WordPerfect and other applications to customers."

WordPerfect competes against Microsoft's Word yet also runs on the Windows operating system. Novell owned WordPerfect from 1994 to 1996.

Microsoft says U.S. antitrust law does not require a company to share it's trade secrets with a competitor and blames Novell for WordPerfect's problems.

"Novell seeks to blame Microsoft for its own mismanagement and poor business decisions," Microsoft said in a press release. "The record is clear that bad decisions and business mistakes are the reasons WordPerfect fell out of favor with consumers."

Novell acquired the WordPerfect word processing program when Novell and WordPerfect Corporation merged in June of 1994.

According to Novell, WordPerfect's share of the word processing market was almost 50 percent in 1990, but fell to less than 10 percent by the time Novell sold WordPerfect and related applications in 1996. Microsoft Word's share of the word processing market rose from approximately 20 percent prior to 1990 to a monopoly share of approximately 90 percent by 1996.

On Monday Microsoft settled a decade-long anti-trust battle with Novell.

That $536 million cash settlement with Novell involved potential antitrust litigation tied to its Netware network operating software, which was once positioned as a potential competitor to Microsoft Windows operating systems software.  Top of page
